Kazakh lawyer Anton Shin addressed disputes between telecom operators and residents' management bodies regarding the leasing of inter-apartment spaces for cable installation. Shin highlighted the illegality of this requirement, as it was recently excluded from Kazakh legislation. Residents faced difficulties connecting to various telecom services due to demands from Owners' Associations and Cooperative Owners' Associations to sign lease agreements for cable installation.
The situation complicates for operators as management bodies of condominiums act as monopolies, hindering operators from installing fiber-optic communication lines in specific buildings. Shin reminded that last year, Kazakh legislators eliminated this legal conflict, granting telecom networks the same status as other essential building systems.
Shin emphasized that the requirement for lease agreements violates the rights of both telecom operators and potential subscribers, contrary to civil code principles. He clarified that only in specific cases, such as the presence of active equipment in buildings, can Owners' Associations demand agreements for shared electricity expenses. Shin warned that hindering telecom operators could jeopardize the national project of "Accessible Internet," crucial for improving internet quality in Kazakhstan.
