Kazakhstan's Majilis Ratifies Legal Assistance Agreement with China

Members of the Majilis at a plenary session on March 20, 2024, ratified amendments to the Agreement between Kazakhstan and China on the provision of legal assistance in civil and criminal cases. The document was sent for consideration to the Senate.

Deputy Snezhanna Imasheva noted that the protocol project specifies the functions of judicial authorities in providing legal assistance in the enforcement of decisions and requests of foreign courts on the territory of Kazakhstan, as well as in changing the competent authorities of both sides.

"The following central institutions have been defined by the protocol: on the side of Kazakhstan – the Supreme Court, the General Prosecutor's Office, and the Ministry of Justice; on the side of China – the Ministry of Justice, the Supreme People's Procuratorate, and the Supreme People's Court. These changes will eliminate the temporary costs for both citizens and authorized bodies in redirecting requests from the competent authority to the Supreme Court of the contracting parties, which in turn will contribute to a faster resolution of issues related to the protection of the legitimate interests of citizens and legal entities," said the Majilis member.

According to her, the adoption of the law will not entail negative socio-economic and legal consequences, nor will it require additional financial expenses from the republican budget.

On January 18, 2024, the Ministry of Justice of Kazakhstan, together with the Republican Chamber of Judicial Officers, launched a pilot project to introduce simplified enforcement proceedings in Taraz.
