Kazakhstan Implements State Control in Healthcare Sector

In Kazakhstan, state control in the provision of medical services is being implemented through investigations. The law "On Amending Certain Legislative Acts of the Republic of Kazakhstan on Business Conduct" was signed by the head of state on April 6, 2024.

Article 34-1 establishes the procedure for investigating the provision of medical services. Investigations are carried out by officials in accordance with the Public Health Code, the Healthcare System, the Entrepreneurial Code, and the procedure for investigating the provision of medical services.

Entities under investigation must provide documents, explanations in writing and electronically, and access to databases. During the investigation, the reasons for violating legislation are determined, and a report is compiled with identified violations and instructions for rectification.

If additional time or resources are needed to address violations, the entity under control can request an extension from the state healthcare authority. Measures are taken against entities found in violation of legislation.

Early rectification of violations must be reported with evidence. Failure to comply leads to unscheduled inspections. The Chief State Medical Inspector can invalidate investigation reports if procedures were not followed.

Appealing investigation reports does not suspend their execution. Amendments in business legislation now include mechanisms for rapid response, investigations, and preventive control without physical visits.
