Kazakhstan Updates Rules on Citizenship Applications Through Diplomatic Missions

The Ministry of Foreign Affairs of Kazakhstan has prepared amendments to the Rules for the acceptance, processing, and consideration of applications by the diplomatic missions of the Republic on issues of Kazakhstani citizenship, loss and deprivation of Kazakhstani citizenship, and determination of affiliation to Kazakhstani citizenship, as reported by a source.

The diplomatic missions send their conclusions and processed documents on citizenship matters to the ministry after coordination through the EIS "Berkut" with the Committee of National Security.

It is also added that the conclusions on applications for renunciation of Kazakhstani citizenship must provide accurate information about the applicant's unfulfilled obligations to Kazakhstan or their property obligations, which are of significant interest to citizens or organizations, about their criminal prosecution, convictions, or serving a sentence based on a legally binding court verdict, or that the renunciation of citizenship by this individual contradicts the interests of national security of Kazakhstan.

The Ministry coordinates the conclusion and processed documents on citizenship matters by affixing a stamp on the conclusion.

A citizen of Kazakhstan permanently residing outside the country submits an application for renunciation of Kazakhstani citizenship through a diplomatic mission with the following documents attached:

  • Notarized statement-consent to renounce Kazakhstani citizenship and absence of material and other claims from the spouse, parents of the applicant, or dependents residing in the country, or copies of death certificates, court decision on declaring the citizen deceased or missing (if applicable).

It is also added that the registration of loss of Kazakhstani citizenship for a person permanently residing outside the country is carried out by the diplomatic mission based on the following documents:

  • Application for registration of loss of Kazakhstani citizenship in any form from the person who acquired citizenship of another state, or an official letter from the authorized body of a foreign state confirming the acquisition of citizenship of another state by the citizen of Kazakhstan.
  • Passport or identity card of the Kazakhstani citizen (original).

In case of absence or loss of the Kazakhstani passport or identity card, a written explanation or other document confirming this fact is provided.

Copy of the foreign passport of the citizen of the foreign state or another document confirming the possession of foreign citizenship.

As explained, for the effective application of the regulations, it is necessary to submit the original of the Kazakhstani identity document, as well as a written explanation in case of absence of documents confirming the Kazakhstani identity.

Within 10 working days from the date of registration of the loss of Kazakhstani citizenship, the diplomatic mission informs the Republican State Enterprise "Information and Production Center" of the Ministry of Internal Affairs of Kazakhstan (RSE "IPC") to enter the information into the database of documented population of the country.

The withdrawn documents confirming the identity of the Kazakhstani citizen are sent by the diplomatic mission within one month from the date of registration of the loss of Kazakhstani citizenship to the RSE IPC for destruction.

Upon receipt of an application for issuance of a certificate of loss of Kazakhstani citizenship, the diplomatic mission issues the applicant with the corresponding certificate, drawn up in any form, within five working days.

A consular fee is charged for issuing the certificate in accordance with the Tax Code and approved consular fee rates.

The document is posted on the Open NPA website for public discussion until May 15.
