Official representative of the Ministry of Internal Affairs of Kazakhstan Shyngys Alekeshev has revealed the circumstances under which the country may refuse citizenship applications. These amendments were signed by the head of state.
The amendments are part of the Law of the Republic of Kazakhstan "On Amendments to Certain Legislative Acts of the Republic of Kazakhstan on the Improvement of Legislation in the Areas of Population Migration and the Penal System," which introduces and clarifies the grounds for refusing citizenship applications in the Law of the Republic of Kazakhstan on Citizenship. The document was signed by the head of state on May 16, 2024.
"Lack of knowledge of the state language at a basic level, as well as the fundamentals of the history and Constitution of our country, may be grounds for refusal of citizenship. The basic level will be determined by the Ministry of Science and Higher Education. The aim of the amendments is to facilitate rapid adaptation and integration into society. Language proficiency is essential for individuals seeking our citizenship to quickly assimilate into society and participate in the life of the state," explained Shyngys Alekeshev during a briefing on May 20.
According to him, many countries require individuals to pass an exam on the history of the state and the state language to obtain citizenship. For example, in Germany, applicants for citizenship are subject to high requirements regarding knowledge of the German language, preservation of German culture and traditions. In Canada, knowledge of the history and duties of a citizen of the country is required, as well as passing a test on English or French language proficiency, depending on the province. In Turkey, knowledge of the Turkish language is mandatory for obtaining citizenship on general grounds.
"To prevent dual citizenship, a new ground for registering the loss of citizenship of the Republic of Kazakhstan is introduced. Citizenship of our country will be lost if foreign passports are used after acquiring Kazakhstani citizenship. Previously, loss of citizenship of the Republic of Kazakhstan was only provided for acquiring citizenship of a foreign state," added Shyngys Alekeshev.
The Law also introduces:
- Refusal to issue permits for permanent residence and acceptance into our citizenship for immigrants who have previously committed sexual crimes against children;
- Entry will also be prohibited if there is information linking foreigners to extremist or terrorist activities;
- Stringent grounds prohibiting the entry of foreigners who are leaders of organized groups or convicted of serious crimes.
