Government sets restrictions on foreign suppliers in state procurement

The government issued a resolution on March 20, 2024, regarding the "Exclusion from the national regime," defining goods and services included in the trusted software registry that can be purchased within state procurement.

This measure aims to protect the domestic market, promote the national economy, and support domestic producers by limiting access for foreign potential suppliers to participate in state procurement of certain goods, works, and services.

The resolution applies to goods and services listed in the trusted software registry and electronic industry products originating from foreign states for state procurement. Exceptions include goods not produced in the territory of the Republic of Kazakhstan and those acquired based on specific provisions of the Law of the Republic of Kazakhstan on state procurement.

Entities listed in the registry of domestic producers of goods, works, and services are allowed to participate in state procurement.

The Ministry of Digital Development will provide the authorized body in the field of state procurement with lists of goods and services included in the trusted software registry and electronic industry products within ten days, along with corresponding codes according to the unified nomenclature directory of goods, works, and services.

The resolution will be effective on May 20, 2024, and it has been reported that state buyers are mandated to purchase domestic light industry goods. Kazakhstan has also excluded a range of imported goods from state procurement for two years.
