Changes in Radio Frequency Spectrum Rules in Kazakhstan Effective May 2024

MCRIAP, by order dated April 22, made changes to the Rules for assigning frequency bands, radio frequencies, operating radio electronic devices and high-frequency devices, as well as conducting electromagnetic compatibility calculations of civil radio electronic devices.

It is stated that the issuance, cancellation, extension, and reissuance of a permit for the use of the radio frequency spectrum of the Republic of Kazakhstan is a state service.

The permit for the radio frequency spectrum is automatically extended for the next year through the portal when the user attaches a confirming document of payment to the state budget of the annual fee for the use of the radio frequency spectrum in equal installments no later than March 25, June 25, September 25, and December 25 of the current year.

The reissuance of the permit for the use of the radio frequency spectrum is carried out within 10 working days.

Cancellation of the permit for the use of the radio frequency spectrum – 10 working days.

To obtain a state service, it is necessary to submit electronically to the Committee of Telecommunications of the Ministry of Digital Development, Innovations and Aerospace Industry of the Republic of Kazakhstan (service provider) through the "e-government" web portal egov.kz:

  • An application (including for ships flying the flag of the Republic of Kazakhstan, including assigning a call sign);
  • An explanatory note, which provides justification for the requested frequency band (nominal) of radio frequencies, detailing the purpose of the topology and architecture of the planned radio network (radio links), the location of its control center relative to the territory of Kazakhstan (within or outside its borders), the standards and protocols used, technical characteristics of radio electronic devices planned for use.

The explanatory note should also include:

  • For satellite communication organizations, a copy of the letter from the satellite communication operator indicating the nominal values (bands) of allocated radio frequencies, effective isotropic radiated power, emission class, type of VSAT stations;
  • Depending on the type of radio communication, a questionnaire is filled out for stationary radio electronic devices for land mobile (on a base station of cellular communication (2G, 3G, 4G, 5G), on a radio electronic device of a wireless local loop system (WLL), on a stationary radio electronic device for ultra-short waves (UHF), short waves (SW), trunking radio communication and data transmission networks) and maritime services (coastal, radio-locating stations, radio beacons), or a questionnaire for a radio relay line, or a questionnaire for a radio and television transmitter, or a questionnaire for a ground station (for ship stations, a completed form with technical data).

After issuing a permit for the radio frequency spectrum or a permit for the radio frequency spectrum for a ship station, the territorial subdivision, in accordance with the Tax Code, sends (for the remaining period of the year) a notice to the service recipient to pay the fee for the use of the radio frequency spectrum to the state budget.

In case of changes in technical parameters, including the installation location of radio electronic devices (changes in geographical coordinates, changes in antenna suspension height, changes in antenna directionality), to obtain an electromagnetic compatibility (EMC) opinion, an application must be submitted to the state radio frequency service with the following documents and information:

  • An explanatory note, which provides justification for the requested frequency band (nominal) of radio frequencies, detailing the purpose of the topology and architecture of the planned radio network (radio links), the location of its control center relative to the territory of Kazakhstan (within or outside its borders), the standards and protocols used, technical characteristics of radio electronic devices planned for use, communication organization scheme, frequency grid (radio channels);
  • Depending on the type of radio communication, a questionnaire is filled out for stationary radio electronic devices for land mobile (on a base station of cellular communication (2G, 3G, 4G, 5G), on a radio electronic device of a wireless local loop system (WLL), on a stationary radio electronic device for ultra-short waves (UHF), short waves (SW), trunking radio communication and data transmission networks) and maritime services (coastal, radio-locating stations, radio beacons), or a questionnaire for a radio relay line, or a questionnaire for a radio and television transmitter, or a questionnaire for a ground station;
  • Information from the agreement on the joint use of the radio frequency spectrum (main user of the radio frequency spectrum, user who has been granted the right to use frequencies under this agreement, radio frequency band designated for joint use, term, number, and date of signing the agreement).

Requirements for participants are also specified:

  • Not being in the liquidation or bankruptcy stage;
  • Having at least five years of experience in the field of communications;
  • Payment of a security deposit to participate in the auctions (receipt).

The order comes into force on May 6, 2024.
