Supreme Court Rules on Waste Disposal Issue in Bishkek's Oktyabrsky District

The Supreme Court has settled the question of who should be responsible for waste disposal in the Oktyabrsky district of Bishkek. According to the city hall, the decisions of the Oktyabrsky District Court dated August 18, 2023, and the Bishkek City Court dated December 7, 2023, have been upheld without any changes. The lawsuit filed by LLC "BishkekVtorResurs" has been rejected.

This means that the termination of the contract for waste removal from June 14, 2023, between the Oktyabrsky district administration and LLC "BishkekVtorResurs" is deemed lawful. The municipality emphasizes that LLC "BishkekVtorResurs" has unlawfully appropriated funds from the municipal enterprise "Tazalyk," totaling 21 million soms, by deceiving the public through fraudulent actions.

Moreover, the company owes 4 million soms to the municipal enterprise "Bishkekskiy Sanitary Landfill" and 4.7 million soms to the municipal enterprise "Tazalyk." The total estimated damage amounts to 46.7 million soms. Once the damage is compensated by "BishkekVtorResurs," a recalculation will be made among the residents of the Oktyabrsky district who are subscribers of the municipal enterprise "Tazalyk."

Residents of the Oktyabrsky district previously received two waste disposal invoices – one from "BishkekVtorResurs" and the other from "Tazalyk." The municipality had announced earlier that the court ruled in their favor, stating that waste disposal in the Oktyabrsky district should be carried out by the municipal enterprise "Tazalyk." However, the company's lawyers disagreed and filed an appeal with the Bishkek City Court.
