President Sadyr Japarov has signed the Law "On Amending Some Legislative Acts (on the laws "On State Pension Social Insurance", "On Tariffs of Insurance Contributions for State Social Insurance")". The press service of the head of state reported this.
The document was adopted by the Jogorku Kenesh on April 3, 2024.
Its goals include ensuring reform in the sphere of pension and tariff policy of state social insurance, creating fair conditions for participants of pension insurance, eliminating outdated norms, and improving the services provided to the population when appointing pensions.
The Law provides for the following norms:
- Basic part of the pension - a part of the pension guaranteed by the state to individuals whose insurance part at the date of pension appointment does not exceed the amount of three subsistence minimums of a pensioner (actually formed in the previous year). At the same time, the amount of adjustment of the basic part of the pension is determined as the difference between the full basic part of the pension and the total pension amount minus the amount of three subsistence minimums of a pensioner (actually formed in the previous year);
- The size of the basic part of the pension is established by the Cabinet of Ministers;
- The basic part of the pension is maintained at a level not lower than 12 percent of the average wage (actually formed in the republic in the previous year) through indexation if the total amount of two pensions is below the subsistence minimum of a pensioner (actually formed in the previous calendar year);
- Accrued pension amounts not claimed by the pensioner in a timely manner shall be paid for past periods, but not more than five years preceding the moment of the pensioner's application for receipt of the accrued pension;
- Individuals listed as involved in terrorist and extremist activities or the dissemination of weapons of mass destruction, convicted of crimes against sexual integrity and sexual freedom of a child, are prohibited from receiving pension accruals and payments, including their payment by proxy, from the moment the court's guilty verdict enters into legal force until release from serving the sentence;
- In the event of the death of a pensioner, the person who carried out the funeral of the deceased shall be paid a burial allowance in the amount of 300 calculation indicators within two weeks after application.
In addition, the document provides for the exemption of heads and members of peasant (farm) households without forming a legal entity, owning a land share and/or plot or its part of less than 1 hectare, from paying insurance contributions.
It is also stipulated that disabled persons of groups I and II and pensioners engaged in individual entrepreneurial activities without forming a legal entity, disabled persons of groups I and II hired by individual entrepreneurs paying taxes in accordance with sub-paragraph "a" of paragraph 1 of part 1, parts 8, 13 of article 423 of the Tax Code of the Kyrgyz Republic, as well as disabled persons of groups I and II and pensioners owning a land share and/or plot or its part are exempt from paying insurance contributions.
The Law comes into force on July 1 of this year, with the exception of points 2, 3, 4, 7, sub-paragraph "a" of point 8, point 12 of article 2 of the document, which will take effect one year after the official publication date.
