Criminal Court Debates in Astana: Lawyer Asserts Defendants' Guilt Beyond Doubt

On May 2, 2024, in the Specialized Interdistrict Court for Criminal Cases of Astana, court debates are taking place in the case of Kuandyk Bishimbayev. The lawyer for the victims, Damir Ishmametov, stated that he had no doubts about the guilt of the defendants, as reported by a correspondent.

Damir Ishmametov emphasized that Bishimbayev partially admitted guilt for causing the death of Nukenova due to negligence resulting from causing serious harm to health. The second defendant in the criminal case did not fully admit guilt. On the court's question about his guilt, Baizhanov stated that he did not know if he had committed a crime. The lawyer said that Baizhanov needed to show some compassion and humanity to immediately call for help, but this was not done.

Furthermore, Damir Ishmametov stated that he had no doubt about Baizhanov's guilt in concealing a particularly serious crime.

The defense's position is that Nukenova forced Bishimbayev to commit the crime. On the day of Bishimbayev's arrest, a video was made by the police where he clearly confessed to beating Nukenova repeatedly.

Damir Ishmametov highlighted that Bishimbayev's statements completely contradict the videos reviewed during the court session.

Earlier, the court announced the end of the judicial investigation and the transition to the parties' debates. The prosecutor, Aizhan Aymaganova, presented the prosecution's position. Later, Saltanat Nukenova's brother, Aitbek Amangelde, appealed to the jury for justice. The victims' lawyer, Zhana Urazbakhova, also spoke in court and stated that the guilt of Bishimbayev and Baizhanov in the committed crime is fully proven by the evidence presented by the prosecution.

During the previous session on April 29, 2024, the court debates in the case of Kuandyk Bishimbayev did not start on time as the defendants did not appear in court due to some issues with the convoy service. Instead of 10:00, the debates were rescheduled for 14:30. After the break, the public prosecutor, Sayakhat Nurbekov, requested to resume the judicial investigation before the start of the debates to file a motion regarding the qualification of the accusation against the second defendant, Bakhytzhan Baizhanov.
