Legal Controversy Surrounding Kemper-Abad Trial: Violations and Defenders' Complaints

The trial of the so-called Kemper-Abad case continues in the Pervomaisky District Court.

According to reports, lawyer Erkin Sadanbekov stated that on Monday, lawyer Keneshbek Dushebaev informed the judge that he would be absent on Tuesday and Wednesday for a valid reason and requested to postpone the process.

"Yesterday, May 7, his motion was considered, and lawyers and defendants expressed the opinion that since the defendants are accused of a particularly serious crime, the lawyer must be present. This is stipulated in the Criminal Procedure Code," he noted.

However, despite this, the court decided to proceed with the process and instructed the state prosecutors to read out the indictment. "It was read to everyone, as they are being tried on the same charge, one storyline. But this is incorrect," he said.

Erkin Sadanbekov added that Keneshbek Dushebaev wrote a statement to the judge yesterday that he could not attend the trial without a lawyer as it would violate his rights. "But in the morning, he was forcibly taken out of the cell and brought to court," the lawyer said.

Due to numerous violations of the Criminal Procedure Code in the administration of justice, lawyers defending the defendants in the Kemper-Abad case have collectively filed complaints to the Chairman of the Supreme Court and the Disciplinary Commission of the Council of Judges against the actions of the judge.

On October 22, 2022, the Committee to Support the Kemper-Abad Reservoir was established. It includes activists, politicians, and parliament deputies. Mass arrests began on October 23 - 27 people were sent to prison on charges of preparing for mass riots. Currently, nine people remain in custody.

Several international human rights organizations, including the International Partnership for Human Rights (IPHR), the World Organization Against Torture (OMCT), the Norwegian Helsinki Committee (NHC), the Helsinki Foundation for Human Rights (HFHR), "Freedom Now," and others, have repeatedly called for the release of politicians and activists detained in Kyrgyzstan.
