Verdict Upheld in Case of Deceased Child from Military Orphanage

The press service of the Supreme Court commented on the statements made by the brother of the deceased ward of the Military-Antonovsky Children's Home, Igor Yakunin Bogdan, regarding violations during the court sessions and the refusal to consider the lawyer's objection to the court session protocol.

According to the Supreme Court's ruling on January 15, 2024, the verdicts of the Sokuluk District Court of the Chui region dated December 12, 2022, and the judicial collegium on criminal and misdemeanor cases of the Chui Regional Court dated July 31, 2023, against J. uulu D. (the convicted party) were upheld, and the cassation appeal was dismissed.

In accordance with the requirements of Article 446 of the Criminal Procedure Code, the cassation court does not conduct an examination of evidence, but is limited to reviewing the complaint, legality of the verdict, and the court's decision on appeal. During the cassation court session, the parties presented their arguments. The victim's lawyer attempted to go beyond the scope of Article 439 of the Criminal Procedure Code. The victim and his lawyer requested the annulment of the court decisions and a retrial at the first instance court. The convicted party, his legal representative, lawyer, representatives of the Public Defender's Office, and the prosecutor requested the dismissal of the victim's cassation appeal and the upholding of the court decisions.

Regarding the victim's arguments about timely submitting objections to the court session protocol, the press service noted that the stamp on the postal envelope received by the Supreme Court was dated February 6. Therefore, the objections were submitted after the five-day deadline stipulated by Article 309 of the Criminal Procedure Code.

It was reported that Igor Yakunin died on June 1, 2021. The head of the NGO "League for the Protection of Children's Rights," Nazgul Turdubekova, revealed that the boy died after being beaten by an older teenager. The incident was covered up. The Ombudsman demanded the removal of the institution's director from office. The deceased's brother, Bogdan Yakunin, addressed the head of state in a video message, requesting oversight of the case concerning his younger brother's death at the orphanage. Over time, the incident was forgotten. It was revealed that only one criminal case was brought to court against the ward who beat Igor, under the charges of "Infliction of grievous bodily harm resulting in death by negligence" and "Hooliganism" of the Criminal Code.
