Investigation Reveals Collusive Conspiracy in East Kazakhstan Region's Competition Violations

The Department of the Agency for Protection and Development of Competition (APDC) of the East Kazakhstan Region has completed an investigation into LLP "Outdoor.kz" and IE "Rammal" for violations of competition legislation.

According to the press release dated May 17, 2024, the investigation was conducted based on signs of a violation stipulated in subparagraph 2 of paragraph 1 of Article 169 of the Entrepreneurial Code of Kazakhstan.

The investigation conducted by the department revealed the fact of collusive conspiracy aimed at influencing, distorting, or maintaining prices at auctions, distorting the outcomes of trades, auctions, and competitions. Consequently, on January 11, 2024, the department initiated a case of an administrative offense under part 1 of Article 159 of the Code of Kazakhstan "On Administrative Offenses" and referred it for consideration to the specialized court for administrative offenses of the city of Ust-Kamenogorsk in the East Kazakhstan Region.

The specialized court imposed an administrative penalty on LLP in the form of a fine amounting to 478,500 tenge, with the confiscation of the monopoly income obtained as a result of anti-competitive actions, totaling 463,210 tenge to the state revenue.
