General Director and his deputy of the subsidiary of JSC "NC "KTZ" - the militarized railway security (MRS) stole over 159 million tenge, as reported by a news source.
According to the court of Astana, on April 29, 2024, the inter-district court on criminal cases issued a verdict on the misappropriation of funds by LLP "MRS".
They were accused of:
- N., being the general director of LLP, in a group of persons in conspiracy with the deputy general director M. and the chief manager S., embezzled funds of LLP in an especially large amount exceeding 159 million tenge, intended for the purchase of a complex of equipment for the video surveillance system;
- Also, N., abusing his powers, employed S. as a driver in the structural unit of LLP and used it for personal purposes, causing damage to LLP in the amount of over 1.5 million tenge in the form of paid salaries.
"In court, the prosecutor supported the accusation and asked the court to impose a sentence of eight years of imprisonment on the defendants. The defendants did not admit guilt, requested acquittal. The representative of the victim requested the court to impose a punishment at the discretion of the court, as well as to satisfy the civil claim. The guilt of the defendants is proven by the testimonies of the employees of LLP, audit reports, expert opinions, and other materials of the criminal case," the statement said.
Court decision:
- By the court's verdict, N. is found guilty of committing criminal offenses under Art. 189 para. 4 pt. 2) and 361 para. 1 of the Criminal Code, and sentenced to eight years of imprisonment, with lifelong disqualification from holding positions in public service and the quasi-state sector;
- M. and S. are found guilty of committing a criminal offense under Art. 189 para. 4 pt. 2) of the Criminal Code, and each sentenced to seven years of imprisonment with lifelong disqualification from holding positions in public service and the quasi-state sector.
The civil claim of the victim is satisfied within the amount of the damage caused, with the recovery from the guilty parties jointly. The verdict has not entered into legal force.
