Former Astana Ambulance Station Head Convicted for Corruption in Bribery Case

In Astana, a verdict has been announced regarding the former head of the City ambulance station.

Two people were on the defendants' bench:

  • Murat Orazbayev, the former director of the State Institution for Public Healthcare "City ambulance station" of the Astana akimat, was accused of committing crimes under Article 366.2 (Bribery on a large scale, as well as receiving bribes for illegal actions (inaction)), Article 366.3.4 (Repeated bribery), Article 361.4 (Abuse of official powers resulting in serious consequences) of the Criminal Code of the Republic of Kazakhstan. During the judicial investigation on April 22, the state prosecutor drew up a new indictment, from which the last article of the accusation was excluded.
  • Larisa Malinovskaya, the former chief paramedic of the City ambulance station, was accused of committing a criminal offense under Article 368.2 (Mediation in bribery) of the Criminal Code of the Republic of Kazakhstan.

The court established that Orazbayev was appointed as the head of the City ambulance station on November 6, 2019.

In 2022, agreements on joint activities were concluded between two medical colleges and the ambulance station. After the conclusion of these agreements, Orazbayev summoned paramedic Malinovskaya, who annually combined her main job with teaching activities.

"Inviting Malinovskaya to his office, he demanded that she pass on a bribe in the form of a portion of the money from the funds that would be received by her as a salary from the aforementioned colleges, for general patronage, including for assistance in providing opportunities for conducting educational practice in medical colleges on a paid basis," the court verdict stated.

Malinovskaya, fearing losing her job, agreed. From May 2022 to August 2023, Orazbayev received bribes from Malinovskaya totaling 676,000 tenge.

Furthermore, the court found that Orazbayev committed a serious corruption crime against the interests of public service and government.

"From January 2022 to April 2023, the chief paramedic Malinovskaya, being an approved mentor, understanding that the LLP "R." was unprofitable to maintain a mentor for a small number of students compared to other colleges, agreed and taught their students together with students from other colleges. At the end of April 2023, Orazbayev, learning the details of the contract concluded with the LLP "R.," summoned Malinovskaya to his office to conclude a new contract with the specified conditions for providing a clinical base," the verdict stated.

Malinovskaya informed Orazbayev of the impossibility of concluding a new contract with different conditions, as the teaching process had already begun and 21 students of the LLP "R." had undergone training together with other groups.

"After hearing Malinovskaya, Orazbayev, with the aim of receiving a bribe in the form of money from representatives of the LLP "R." upon learning about the increase in the number of students undergoing internships with them, informed her of the need to transfer a bribe through her in the amount of 100,000 tenge for providing the opportunity for the academy students to undergo practical training in the conditions of the enterprise's clinical base, to which Malinovskaya agreed to mediate in bribery," the court document stated.

Malinovskaya called the deputy director of the LLP "R." informing about Orazbayev's demand. The deputy director agreed. On April 25, 2023, Malinovskaya transferred the specified amount to Orazbayev.

In court, Orazbayev partially admitted guilt - only for the first episode. Malinovskaya admitted guilt fully.

After examining all the evidence and case materials, the court concluded that the guilt of the defendants was proven.

Larisa Malinovskaya was also sentenced to a fine in the amount of 20 times the bribe, which is 2,000,000 tenge, with a lifetime ban on holding positions in public service.

A sum of 776,000 tenge was also recovered from Orazbayev as the amount of the bribe to the state.

The Anti-Corruption Service reported the arrest of the director of the State Institution for Public Healthcare "City ambulance station" Orazbayev in December 2023.
