Supreme Court of Kazakhstan Clarifies Verdict in Bishimbayev Case: 24-Year Sentence Issued

The Supreme Court of Kazakhstan clarified the verdict in the case of former minister Kuandyk Bishimbayev and the director of "Gastrocenter" Bakhytzhan Bayzhanov on May 13, 2024.

In the Supreme Court of the Republic of Kazakhstan, it was reminded that the case was considered with the participation of jurors.

The verdict of the jurors:

  • Kuandyk Bishimbayev was found guilty of causing physical and mental suffering to the victim Nukhanova S. from mid-March to November 9, 2023, through systematic beatings or other violent actions towards a person dependent on the guilty party, as well as for the murder of Nukhanova S. on November 9, 2023, committed with particular cruelty.
  • Bakhytzhan Bayzhanov was found guilty of concealing a particularly serious crime committed by Kuandyk Bishimbayev on November 9, 2023.

The guilt of the defendants was proven by the victim's testimony, witnesses, audio-visual materials, expert opinions, and other materials of the criminal case. The prosecutor requested a sentence of 24 years for Bishimbayev and four years of imprisonment for Bayzhanov. During the court hearing, the defendants did not admit guilt.

Decision on punishment:

  • The penalty for the actions under Article 110, Part 2, of the Criminal Code of the Republic of Kazakhstan involves imprisonment for a period of four to seven years.
  • The penalty for the actions under Article 99, Part 2, of the Criminal Code of the Republic of Kazakhstan involves imprisonment for a period of 15 to 20 years or life imprisonment.
  • The penalty for the actions under Article 432 of the Criminal Code of the Republic of Kazakhstan involves imprisonment for up to six years.

According to Article 53 of the Criminal Code of the Republic of Kazakhstan, the court acknowledged the presence of underage children as mitigating circumstances regarding the defendants Bishimbayev and Bayzhanov.

As aggravating circumstances for Bishimbayev, the court recognized, based on Article 14, Part 2, of the Criminal Code of the Republic of Kazakhstan, a dangerous recurrence of crimes, as well as the commission of a criminal offense in a state of alcoholic intoxication.

The question of the punishment size was decided by the judge and jurors in accordance with Article 656 of the Criminal Procedure Code of the Republic of Kazakhstan through open voting, taking into account the majority of votes.

The court's verdict with the participation of jurors:

  • Kuandyk Bishimbayev was sentenced to 24 years of imprisonment for the aggregate of crimes.
  • Bakhytzhan Bayzhanov was sentenced to four years of imprisonment (considering Article 55, Part 2, of the Criminal Code of the Republic of Kazakhstan).

The court's verdict has not yet entered into legal force.

Previously, it was reported that Kuandyk Bishimbayev was sentenced to 24 years of imprisonment, and Bakhytzhan Bayzhanov to four years of imprisonment.
