Supreme Court of Kazakhstan Upholds Life Sentence in Cassation Case

The Supreme Court of Kazakhstan, chaired by the Chairman of the Supreme Court Aslambek Mergaliev, considered a criminal case in cassation against Togaev A. Zh.

The hearing was held with the participation of the convicted Togaev, his defense lawyer, and a representative of the victim, all participating online.

The state prosecution was supported by Deputy Prosecutor General Asset Chindaliev.

"In February of this year, Togaev filed a motion to review the court decisions regarding him, challenging the qualification of his actions and the punishment. Following the review, the judicial panel of the Supreme Court decided to uphold the court decisions without changes, and the motion of the convicted individual was not granted," the statement from the Supreme Court of Kazakhstan reads.

According to the case materials, by the court verdict of June 25, 2014, Togaev was found guilty of committing murder, coupled with robbery and banditry, robbery combined with violence dangerous to the life or health of the victim, committed by illegal entry into a residential premises, use of weapons, inflicting serious harm to health, organized group, on an especially large scale, as well as in the creation of a stable armed group (gang).

It is noted that Togaev's guilt was partially proven by the confessions of the convicts, the testimony of the victim, witnesses, conclusions of forensic and biological examinations, results of the crime scene inspection, and seizure.

"The imposed punishment in the form of life imprisonment is lawful, justified, and fair, taking into account the public danger of the committed actions, the personality of the previously convicted Togaev, whose actions demonstrate a dangerous recurrence of crimes and an especially active criminal role," the statement concludes.
