Uzbekistan Establishes Minimum Utility Payments for Multi-Apartment Buildings

In Uzbekistan, minimum sizes of mandatory contributions or payments for the maintenance, operation, and repair of common property, as well as landscaping of the land plot adjacent to a multi-apartment building, have been established. This is stipulated by the order of the Minister of Construction and Communal Services, Batyra Zakirova, dated April 15.

The introduction of minimum utility payments was provided for by the decree of President Shavkat Mirziyoyev dated August 23, 2023 (PP-278).

The amount of utility payments depends on the number of floors in the building. For example, in Tashkent, for two-story buildings with utilities, the tariff will be 1147-1149 sums per square meter depending on the area, for 3-story buildings - 1303-1305 sums, 4-story buildings - 1514-1518 sums, 5-story buildings without elevators - 1512-1514 sums, 6-story buildings with elevators - 1710-1712 sums, 7-story buildings - 1703-1709 sums, 8-story buildings - 1701-1707 sums, 9-story buildings - 1700-1706 sums, and buildings with 10 or more floors - 1828-1830 sums.

In Samarkand region, the minimum utility payment ranges from 1018 to 1712 sums, and in Tashkent region - from 996 to 1707 sums. The amounts for other regions are specified in the order of the head of the Ministry of Construction and Communal Services (PDF).

Minimum Utility Payment in Tashkent

Previously, the Ministry of Construction and Communal Services clarified that to avoid possible confusion in calculations in the billing system "Menung uyim," it is recommended to apply the minimum tariff from May 1, 2024.

The Ministry also recommended not to recalculate for owners who have paid utility bills in advance (but not more than a year) in order to encourage honest and responsible payers. However, this matter is an internal affair of the management body and owners of premises in a multi-apartment building and is regulated by the terms of the contract, the society's charter, and the established practices in the management body, or agreements between owners and the management body, documented by the relevant protocol.

As part of the implementation of this order, the Ministry will conduct additional analysis by 2025 and, if necessary, will establish a new minimum tariff next year.

The list of minimum works and services that the management body must provide when setting the approved tariff, is outlined in order No. 3501. Among them are: providing electricity to common use objects in multi-apartment buildings, technical monitoring of elevator equipment (in cases of a contract with a specialized service organization), maintenance and repair of facades and entrances (repair, plastering, painting of doors and walls in the entrance), ensuring the technical condition of drinking water pumps installed in the basement (except for multi-apartment buildings where drinking water pumps are not intended for installation during construction), restoration and repair of the waterproofing layer of the roofs of buildings, maintenance of communication networks in the basement and shaft, power supply networks (painting, whitewashing, repair, replacement of common electrical cables, repair of vertical and horizontal pipes, drinking water pipes, etc.), maintaining gutters in good condition and regular cleaning, and other tasks (a total of 16 points).

In the Ministry's press service, it was emphasized that the tariff amounts are determined by the decision of the general meeting of residents. If they accept the specified minimum utility payments, they will be entitled to demand the completion of the 16 points of work and services.

According to the law "On the Management of Multi-Apartment Buildings," the amount of mandatory contributions or payments from owners of premises for the maintenance, operation, and repair of common property and landscaping of the land plot adjacent to a multi-apartment building is established by the decision of the general meeting, which also determines the method of building management.

It is worth noting that in 2018, minimum utility payment amounts were also introduced and later canceled in Uzbekistan.
